Agreeing to these terms

This website is operated by [Tekmaze legal entity name] ("Tekmaze", "we", "us"). By using guestmetric.com you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site. We may update these terms by posting a new version here with a new date; your continued use after that means you accept the change.

The website and the platform are different things

This site describes GuestMetric and lets you contact us. It does not give you access to the GuestMetric platform. Access to the platform, including any pilot, is provided only under a written agreement between Tekmaze and a customer, such as a master subscription agreement and order form. If these terms and that agreement ever conflict about the platform, the agreement wins.

Using the site

You may view the site and use its forms for their intended purpose: learning about GuestMetric and contacting us. You agree not to:

• use the contact form to send spam, unsolicited offers or anything unlawful, or to submit information that is false or that you are not entitled to share;
• interfere with the site's operation or security, probe or test its vulnerabilities without our written permission, or try to get around rate limits or access controls;
• scrape, harvest or copy the site's content in bulk, or use automated tools to access it other than ordinary search-engine indexing;
• remove or alter any copyright, trademark or other notices;
• use the site in any way that violates applicable law.

We may suspend or block access to the site for anyone we reasonably believe is violating these terms.

Our content and marks

The site and everything on it, including text, design, illustrations, product mockups, graphics, logos and code, belong to Tekmaze or our licensors and are protected by copyright, trademark and other laws. You may view the site and print or save pages for your own evaluation of GuestMetric. Any other use, including reproducing or distributing the content or using it to build a competing product or marketing material, needs our written permission. Illustrative content, estimates and the calculator

The product screens, figures, store names, people and results shown on this site are illustrations built to explain how GuestMetric works. They are not data from any real restaurant, brand or customer, and they are not a promise of what GuestMetric will measure or find in your locations.

Any dollar figures on this site, including the walkout calculator, are examples or simple arithmetic on numbers you enter. They are not forecasts, financial projections or advice, and actual results depend on factors we do not control, including your operations, staffing, traffic and the decisions you make. GuestMetric's in-product estimates are likewise shown as ranges with their assumptions and confidence, and are never guarantees of revenue or savings.

Product descriptions reflect our current plans and capabilities and may change. Nothing on this site should be relied on as a commitment to deliver any particular feature by any particular date.

What you send us

When you send information through the site, you confirm it is accurate and that you are allowed to share it. If you give us ideas, suggestions or feedback about GuestMetric, you agree we may use them without any obligation to you. How we handle your personal information is described in the Privacy Policy, and how we may contact you after a request is described in Legal Notices.

Third-party sites and marks

The site may link to other websites. We do not control them and are not responsible for their content or practices. Names of other companies, brands and products that may appear on this site belong to their owners, and their appearance does not mean they use, endorse or are affiliated with GuestMetric or Tekmaze unless we say so explicitly.

No warranties

The site is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the site will be accurate, uninterrupted, secure or free of errors. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

Limits on our liability

To the fullest extent the law allows, Tekmaze and its officers, employees and agents will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profits, revenue, data or business opportunity, arising from your use of or inability to use this site, even if we were told it was possible. Our total liability for any claim relating to the site will not exceed one hundred U.S. dollars. These limits do not apply to liability that cannot be limited by law, and they do not limit either party's obligations under a separate written agreement for the GuestMetric platform.

Your responsibility for misuse

If your violation of these terms or your misuse of the site causes a third party to make a claim against Tekmaze, you agree to defend and indemnify us against that claim and any resulting costs, including reasonable legal fees.

Governing law and disputes
